General conditions.

The reservation/purchase made by the Client implies the agreement and acceptance of these General Conditions. No stipulation made by the Client on these Conditions may differ from those established by Maryla Vázquez Zermeño, hereinafter Toursefarad.

It will be understood that the Client has read, understands and freely accepts these Conditions

General when he makes his purchase.

The Client acknowledges being informed of the description of the service, and all the information contained in it, meeting time and place, duration, chosen date and number of people.

 

  1. RESPONSIBILITIES

1.1 In the event that the Customer provides data from a third party when making the reservation/purchase, the Customer will be solely responsible for the third party knowing and expressly accepting such situation. All responsibility for damages that may arise from this fact will fall entirely on the Client, excluding Toursefarad from any liability.

1.2 Toursefarad is not responsible for what is exclusively attributable to the Client.

1.3 Toursefarad is not responsible for the waits that could originate in the accesses of the monuments to be visited or visits to be made, either by the organization and/or internal organization of the monument.

1.4 Toursefarad is not responsible for delays caused in services that require transportation due to traffic delays.

1.5 Toursefarad does not accept responsibilities derived from its services, for not meeting customer expectations.

1.6 Toursefarad is not responsible in any way (neither direct nor subsidiary) for any direct or indirect damage that the Client may suffer or cause to himself or to third parties.

1.7 The abandonment or separation of the group during the visit, for reasons not attributable to Toursefarad, supposes the loss of all claim rights.

 

  1. PAYMENTS

2.1 Payment is made at the time of booking/contracting the service through the payment platforms enabled by the Responsible Party such as Stripe, Paypal, Revolut,Transfer, Wise and following the instructions set by Toursefarad.

2.2 The Client must take into account making the payment of his reservation/purchase in EUROS, all possible bank commissions for currency exchange will be borne by the Client.

2.3 Payment of the purchase amount must be received by Toursefarad free of bank commissions or other expenses derived from the transaction.

2.4 Minors under 12 years of age accompanied by their parents or legal representatives, the service may be free depending on the specific case and depending on the criteria established by Toursefarad.

 

  1. CANCELLATION AND RETURN 

3.1 In the case of guided tours, once the booking has been confirmed, certain charges will apply that cannot be refunded.
3.2 Cancellations made less than 78 hours before the scheduled date of the service, as well as no-shows on the day of the service, will result in a charge of 100% of the total amount.
3.3 The cost of tickets is non-refundable.
3.4 Ticket costs and management fees (15%) are non-refundable.
3.5 Cancellations made more than 31 days in advance will be eligible for an 80% refund of the amount paid or the issuance of a voucher valid for one year.
3.6 Cancellations made between 21 and 31 days in advance will be eligible for a 50% refund of the amount paid or the issuance of a voucher valid for one year.
3.7 Refunds will be made using the same payment method used for the original purchase, within a maximum of 48 hours from the receipt and acceptance of the cancellation request.
3.8 In accordance with Royal Legislative Decree 1/2007 of November 16, these services are not subject to the right of withdrawal.
3.9 In the event of service suspension due to force majeure, the client will be contacted to offer another date, another guide, or a full refund of the amount paid using the same payment method.
3.10 In cases of widespread emergencies beyond TourSefarad’s control (health, weather, security, etc.), cancellations and refunds for contracted services will not be possible. 

3.1 In the case of guided tours once confirmed, it entails the following expenses that will not be returned:

 

  1. COMMUNICATIONS

4.1 The Client undertakes to always keep the e-mail address provided for fluid communications with Toursefarad operative, active and updated, as well as the mobile phone, for agile and problem-free management in the reservation/purchase process.

4.2 All responsibility will fall on the Client for the consequences that the lack of operation of their e-mail address or mobile phone or that the absence of communication to update said data in our records could produce.

 

  1. LEGAL INFORMATION

5.1 The Client declares that he is not under 14 years of age and if he were to have the corresponding parental or legal guardian permission to make reservations/purchases with Toursefarad, he likewise declares that he has sufficient legal capacity to do so.

5.2 The Client will indemnify Toursefarad for all expenses that may arise in the event of being imputed by the Client (or by third parties related to the Client because of the reservation/purchase), in any cause whose responsibility was not directly attributable to him, including in such compensation the fees and expenses of Toursefarad’s lawyers, even when the judicial decision was not final.

5.3 In matters not provided for in this document, as well as in the interpretation and resolution of conflicts that may arise between the parties as a result thereof, Spanish legislation will apply.

5.4 If any conflict or difference arises between the parties (Client and Toursefarad) in the interpretation and execution of this document, and it is not resolved by mutual agreement, it will be resolved at the request of either party and after communication by written to the other, by arbitration.

5.5 All of the foregoing shall be understood without prejudice to the fact that the parties may submit to legal proceedings, in which case it shall be done before the jurisdiction and jurisdiction of the Courts and Tribunals of Granada.

 

  1. Data Protection and Privacy

Toursefarad, in compliance with  the arts. 7 y 13 of RGPD 2016/679 and LOPDGDD 3/2018,  here by informs you that your personal data, be stored in the Registry of Treatment Activities Clients. The purpose of this is to be able to carry out an efficient management of the services provided to our clients as Tourist Guides. That personal data will not be assigned to countries that are not members of the EU, to any public or private organisation whatsoever unless this should be necessary due to legal obligations and in order to provide the contracted services or if it should be necessary as in the case of the daily reports issued for the National Security Forces, pursuant to current legislation.  These data are stored until the end of the professional relationship except in the case of those whose subsequent storage over time respond to existing legal obligations. Likewise, it is informed of the possibility of access to the Customer’s own information by external companies that provide services, guaranteeing the highest level of confidentiality already regulated (The Company has all the information related to these companies so that they can be consulted upon request).

The use and processing of customer data to which the owner could access, will be treated exclusively to maintain the commercial relationship between the two, exempting Toursefarad from any liability in the event of improper use.

I  have been informed of and I accept the assignment of my information to Toursefarad for the purpose of sending advertising and/or commercial information by SMS and/or E-MAIL and /or Whatsapp, and I may exercise my right of opposition at any time before the File Manager.

Affected parties may exercise their rights of access, correction, cancellation, opposition and portability of your data, and the limitation or opposition to your treatment, withdraw the consent in this accepted document and even file a claim with the Spanish Agency for Data Protection before the File Manager.
